Terms of use

These terms apply to your use of surgery.com and everything on it (“the site”). By using the site you agree to them. If you do not agree, please do not use the site.

Not medical advice

The site gives general information about cosmetic and plastic surgery and what it costs. It is not medical advice, diagnosis or treatment, and it is not a substitute for a consultation with a qualified, licensed physician. Decisions about surgery should be made with your own surgeon. If you think you have a medical emergency, call 911 or your local emergency number.

No doctor–patient relationship

Using the site, including its directory, its tools, or a request sent through it to a practice, does not create a doctor–patient relationship with Surgery.com or with any surgeon or practice listed on it. Surgery.com does not provide medical services and does not employ the surgeons it lists.

Estimates are not quotes

A typical cost on the site is an estimate worked out from prices practices have published or confirmed, adjusted for local price levels (see how we estimate). It is not a quote or an offer from anyone. What you pay depends on your consultation, your surgeon, and what your quote includes. Practices that publish a price may price differently from those that do not.

Accuracy

We check each price against its source and say on each profile what we have and have not checked, but information changes and mistakes happen. The site is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose and non-infringement. Before relying on anything here — a price, a license, a board certification, what a surgeon performs — confirm it with its source, the practice, or the licensing or certifying body. A listing is not an endorsement or a recommendation.

Advertising

Any paid placement on the site is labeled “Sponsored”.

What you send us

When you send us something — a message, a correction, a consultation request, or information about a practice — you confirm that it is accurate as far as you know, that you are entitled to send it, and that it does not infringe anyone’s rights. You give us permission to use it to run the site, for example to review and publish a correction or to pass a request to the practice you chose. How we handle personal information is set out in the privacy notice. Tools that say they work on your device keep what you enter in your browser.

Acceptable use

You agree not to:

• use the site for anything unlawful, or to harass, deceive or impersonate anyone;
• send false information, including false corrections, claims or requests;
• interfere with the site’s operation or security, or try to reach parts of it that are not public;
• copy the site’s data in bulk by automated means, except as its robots.txt allows or with our written permission;
• use the site to send unsolicited marketing to the practices or surgeons listed.

We may restrict access for anyone who breaks these terms.

Intellectual property

The site’s design, text, compilations and software belong to Surgery.com or its licensors. Public records and government data it draws on remain public, and published prices belong to the practices that published them. You may quote and link to pages on the site with attribution; the price report’s data tables may be reused with the citation the report gives.

Links to other sites

The site links to practices’ websites, licensing boards, certifying bodies and other third-party sites. We do not control them and are not responsible for their content, practices or availability.

Limitation of liability

To the fullest extent the law allows, Surgery.com and its owners, staff and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of, or reliance on, the site or any surgeon, practice or third-party site it lists or links to. Where liability cannot be excluded, it is limited to one hundred U.S. dollars. Some jurisdictions do not allow some of these limits, so they may not all apply to you.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in California, unless the law where you live gives you the right to bring it elsewhere.

Changes

We may change these terms. The date at the top says when they last changed; using the site after a change means you accept the new terms.
